Coimbatore: An arbitral tribunal has delivered a verdict, mandating JMJ Housing Ltd. and its director to compensate Champion Textiles Ltd. with ₹7.75 crore over disputes pertaining to a residential development project. The decision stemmed from an arbitral award issued on October 12, 2026.
The tribunal, led by Justice T. Ravindran, a former Judge of the Madras High Court, ruled in Arb. O.P. (Com. Div.) No. 394 of 2024. This ruling arises from a complicated dispute centered on a Joint Development Agreement (JDA) established on January 19, 2022, regarding land in Pattanam village, located in the Coimbatore district.
Champion Textiles Ltd. initiated the agreement with JMJ Housing Ltd. to pursue residential development projects, with significant expectations from both parties. However, disagreements quickly emerged regarding construction responsibilities and property transactions.
Key allegations presented by Champion Textiles claimed that JMJ Housing violated the terms by transferring certain plots to third parties without consent. Additionally, the textile firm highlighted issues regarding the lack of necessary agreements before registration of some property transactions.
In response, JMJ Housing Ltd. countered these assertions, arguing that they had engaged in substantial preparatory work and incurred costs towards the development initiative. Yet, the tribunal scrutinized both parties’ submissions, uncovering discrepancies.
After rigorous review of the evidence and testimonials, the tribunal determined that JMJ Housing breached their contractual obligations. It ruled in favor of Champion Textiles, supporting claims concerning the invalidity of certain property transfers.
In its verdict, the arbitral tribunal concluded that the disputed transactions contradicted the terms of the development agreement, subsequently instructing the cancellation of the contentious sale deeds. The tribunal held that a total compensation of ₹7.75 crore would be awarded to Champion Textiles, reflecting the financial implications of the breaches.
The tribunal’s financial directives included two compensation components. They ordered JMJ Housing Ltd. and its director to pay Champion Textiles ₹6.75 crore, with a significant interest rate of 18% per annum applicable from March 13, 2025, until the full sum is paid. Additionally, the tribunal awarded an extra ₹1 crore, also accruing at an 18% interest rate from the date of the award to the time of payment.
Moreover, aside from financial recompense, the tribunal mandated the annulment of 10 specific sale deeds linked to the disputed property. They also instructed the involved parties to hand over vacant possession of the designated property to Champion Textiles within a month of the award issuance.
This comprehensive judgment aims to rectify the complications stemming from the contractual breaches identified by the tribunal. Furthermore, as part of the arbitration proceedings, both sides presented claims regarding their obligations and the legitimacy of third-party transactions.
Champion Textiles not only sought the annulment of dubious transactions but also requested possession recovery alongside monetary compensation. The tribunal’s detailed assessment of the evidence and contractual terms continues to clarify the framework of the agreement.
While the award was officially sanctioned on October 12, 2026, its legal implications and enforcement of the directives will unfold in the coming period, as they hinge on subsequent legal proceedings.
